Every personal bankruptcy client has certain rights and responsibilities under the Bankruptcy Code.
Each client will receive an explanation of Chapter 7, 11, 12, and 13 of the Bankruptcy Code and an explanation of the general purpose, benefits, and costs of proceeding under each of those chapters.
Each client will receive a description of the credit counseling requirements as they relate to the filing of a bankruptcy petition. I understand that before I can file a bankruptcy petition, I must complete a credit counseling course from an approved credit counseling agency. This pre-petition credit counseling course shall be at my own expense.
Each client will receive a must take and complete a personal financial management course from an approved credit counseling agency prior to receiving a discharge of their debts. This pre-discharge credit counseling course will be at their own expense.
Each client will receive a copy of the Notice required by Section 342 of the Bankruptcy Code
Each client will receive the following information during the initial client consultation:
(A) a person who knowingly and fraudulently conceals assets or makes a false oath or statement under penalty of perjury in connection with a case under this title shall be subject to fine, imprisonment, or both; and
(B) all information supplied by a debtor in connection with a case under this title is subject to examination by the Attorney General.
Each client will receive a copy of the Disclosures required by Section 527(a)(2) and 527(b) of the Bankruptcy Code. Each client must read these Disclosures and to comply with the legal requirements as set forth in the Disclosures.
Each client will receive a copy of the Davidson Backman Medeiros, PLLC Engagement Letter, detailing their contractual relationship with Davidson Backman Medeiros, PLLC, and review the Engagement Letter with Davidson Backman Medeiros, PLLC. Each client will receive a complete copy of the fully executed Engagement Letter following the employment of Davidson Backman Medeiros, PLLC.
